WINDTRE, as provided for in the General Contractual Conditions in article 3.2, reserves the right to temporarily limit the speed of the data connection to Customers whose usage patterns may compromise the performance of the network itself. This may occur when using Services that make intensive use of network resources and/or in areas with a particularly high number of connections.
Traffic (voice and/or data) is unlimited unless used contrary to the principles of honest use and good faith or for purposes other than personal use, as set out in article 6 of the General Contractual Conditions. In the event of improper use or use that exceeds the reasonable limits of use for personal purposes by the customer, WINDTRE will have the right to suspend the Service, in whole or in part, with prior notice, or replace the plan subscribed to. The Customer will have the right to withdraw with immediate effect without any penalties being applied.
The limitations are:
For all offers that include Voice and SMS
1. daily outgoing traffic per SIM not exceeding 160 minutes and/or 200 SMS/MMS
2. monthly outgoing traffic per SIM not exceeding 1250 minutes and/or 2000 SMS/MMS
3. daily/monthly outgoing traffic (minutes and/or SMS/MMS) per SIM to other operators not exceeding 60% of the total outgoing traffic and in any case not exceeding 50% of the total mobile traffic
4. daily/monthly outgoing traffic (minutes and/or SMS/MMS) per SIM to a single mobile operator other than WINDTRE not exceeding 40% of the total outgoing traffic and in any case not exceeding 30% of the total mobile traffic
5. daily/monthly outgoing traffic (minutes and/or SMS/MMS) per SIM to your own WINDTRE user network must not exceed 80% of the total outgoing traffic
6. daily outgoing or incoming traffic used for automatic top-up purposes not exceeding two hours of conversation and 50 SMS or MMS
For all offers that include unlimited Voice, SMS or data
Parameters 1, 2, 3, 4 and 5 above do not apply and the use of the Service that complies with the following parameters is presumed to be personal:
7. daily outgoing calls or SMS to other operators not exceeding 60% of total outgoing calls or SMS.
8. no more than 3 (three) outgoing calls or SMS to other operators per day for each call or SMS received from other operators; warnings for exceeding this limit will not be applied automatically.
Parameters 1, 2, 3, 4 and 5 indicated above are not applied and, provided that any automation in the application of the precautions envisaged in overcoming them is absent, the use of the Unlimited data service that exceeds the following parameters is presumed not to be personal: 1. abnormal monthly traffic volumes and at least 5 times higher than the average usage by customers with the same or similar offers; 2. data traffic volumes higher, for three consecutive months, than the average monthly traffic volume of customers with the same or similar offers.

Conditions of use Switch to WINDTRE
1. By requesting Switch to WINDTRE (hereinafter also referred to as the “Service”) you subscribe to the number portability service between operators of the mobile and personal communication service (Mobile Number Portability or MNP), which allows you to choose Wind Tre S.p.A. (hereinafter WINDTRE) as your mobile operator while maintaining your mobile network telephone number, and express your desire to withdraw from the contract/terminate the legal relationship in place with the previous operator (hereinafter “transferor operator”). These conditions of the mobile number transfer service also apply, where technically possible and after verification with authorized WINDTRE retailers or customer service, to the internal number portability service from a SIM of a WINDTRE trademark to another SIM with a different WINDTRE trademark.
2. The request for Switch to WINDTRE is subject to the existence/establishment of a relationship, subscription or prepaid, for the provision of the mobile radio service with WINDTRE and the relative conditions of supply. Consequently, if a condition that prevents the Customer from activating it is found, as established in the general conditions of supply of the mobile radio service, subscription or prepaid, WINDTRE will not forward the request for provision of the Service to the transferor operator.
3. Switch to WINDTRE can only be requested by the holder of the SIM/telephone number with the transferor operator. Without prejudice to any different agreement between WINDTRE and the transferor operator (which WINDTRE will communicate to you), at the same time as the request for Switch to WINDTRE, you may request from WINDTRE (which will forward the request to the transferor operator) the transfer service of any residual credit left on the prepaid SIM card of the transferor operator at the time of its deactivation. We wish to remind you that the transfer of the residual credit will be carried out according to the terms and conditions of the service applied by the transferor operator; in particular, the residual credit will be transferred net of any free traffic included or in any case associated with the telephone plan or promotions, options or active top-up mechanisms and net of the fee for the service applied by the transferor operator; furthermore, the transfer will not take place in the event of insufficient, zero or negative credit. The request for transfer of the remaining credit is irrevocable and the transfer is subject to the activation of the portability service for the number to which the credit is associated. The transfer of credit will take place in the following ways:
a) in the case of a prepaid service, by crediting the WINDTRE prepaid card;
b) in the case of a subscription service, by crediting the invoice(s) relative to the subscription to the WINDTRE mobile radio service. Alternatively, or in the event that the transfer of credit does not take place for any reason, a refund may be requested directly from the transferor operator through the methods they use.
4. We wish to remind you that the establishment of the relationship for the provision of the mobile radio service with WINDTRE, on a subscription or prepaid basis, does not release you from the obligations related to the previous contract stipulated with the transferor operator and that any situations of non-fulfilment towards the transferor operator and/or the previous transferor operators (in the case of requests related to numbers already subject to portability) may constitute a condition preventing the provision of Switch to WINDTRE.
5. The request for activation of the Service may be subject to refusal by the transferor operator in the following cases:
a) completion of another portability request for the same telephone number;
b) mismatch between the Tax Code/VAT number and the transferred telephone number
c) in the case of a lost or stolen or non-functioning SIM
d) definitive deactivation of the transferred telephone number;
e) non-ownership or inaccuracy of the telephone number transferred to the transferor operator;
f) incompleteness of the data provided by the Customer;
g) exceeding the handling capacity made available by the transferor operator. WINDTRE will always carry out preventive pre-validation to verify that the SIM being transferred is active. In all the cases listed above, WINDTRE will inform you of the temporary or permanent impossibility to activate the Service.
6. WINDTRE will communicate the activation date of the Service to the Customer. Without prejudice to the cases referred to in the previous art. 5 for which the reason for the refusal is attributable to the Customer, WINDTRE will be liable for delays in activating the Service starting from the third working day following the activation date communicated. In such cases, upon request of the Customer, WINDTRE will pay the latter compensation of 2.50 euro for each working day of delay up to a total maximum of 50 euro.
7. During SIM deactivation operations by the transferor operator and activation of the Service, a period of temporary interruption/suspension of the mobile telephone service regarding the number subject to portability may occur.
8. In addition, the following conditions apply: - calls made will in any case be charged according to the operator to which the called party belongs, regardless of the telephone prefix. The rate transparency service is available by dialling 456 followed by the number you wish to call; for any changes/corrections, please refer to the WINDTRE institutional website; - in the case of a new subscription, the activation of the mobile radio service by WINDTRE is subject to the activation of Switch to WINDTRE and, therefore, if the activation of the latter Service is not possible, the Contract Proposal cannot be accepted and, in any case, the Subscription Contract concluded will be automatically terminated. Alternatively, upon your request, the mobile radio service will be activated with a WINDTRE number which will then be replaced by the transferred number. In this case, if the activation of Switch to WINDTRE is not possible, the SIM will remain active with the WINDTRE number and the Subscription Contract will therefore remain valid and effective; - in the case of a prepaid service with WINDTRE, the Switch to WINDTRE activation process is subject to the prior activation of the prepaid SIM; if the Service is requested on a SIM with an already active WINDTRE number (without prejudice to any limitations described in point 1), this number will be deactivated and replaced by the transferred number; - Switch to WINDTRE can only be requested in relation to the main telephone number; any additional numbers associated with it will not be subject to portability and, consequently, will be lost - WINDTRE is not obliged to support International Roaming services provided by a specific alternative supplier active with the transferor operator.
9. Any fee for Switch to WINDTRE – calculated based on the economic conditions in force at the time of the request – will be charged to you upon activation of Switch to WINDTRE in the following ways:
a) in the case of a subscription service, on the invoice regarding the subscription to the WINDTRE mobile radio service;
b) in the case of prepaid services, on the credit on the WINDTRE prepaid card.
CONDITIONS FOR SWITCHING FROM SUBSCRIPTION TO PREPAID
1) The activation of the mobile radio service for the Prepaid SIM will take place within 48 hours of deactivation of the Subscription Contract.
2) Upon deactivation of the Subscription Contract, all options/services active on the SIM itself and not compatible with the Prepaid offer will be deactivated. The bonuses/credits accrued in relation to the aforementioned options/services will not be credited.
3) The options and services already active on the Subscription SIM will be automatically activated on the Prepaid SIM at the time of subscription, without incurring any cost, provided that such options/services provide for it and are available on the Prepaid service.
CONDITIONS FOR SWITCHING FROM PREPAID TO SUBSCRIPTION
1) The activation of the mobile radio service in the subscription will take place within 48 hours of deactivation of the Prepaid SIM, provided
that the value of the residual credit of the latter is between a minimum of 0 euro and a maximum of 200 euro. Otherwise, WINDTRE reserves the right to refuse the requested switch referred to herein and, consequently, the proposal for the Subscription Contract associated with it.
2) When the prepaid SIM is deactivated, all the options/services active on the SIM itself will be deactivated. The bonuses/credits accrued in relation to the aforementioned options/services will not be credited.
